When discussing a case with your client, one item on the agenda should be mediation. Why mediation? Parties determine for themselves what is important, issues can be resolved or narrowed, avoiding delays and saving enormous amounts of time, energy and expense associated with protracted conflict and litigation.

Conducting mediation over the phone, or by video, is a newer option to the face to face mediation. It works exactly the same. The rules of confidentiality, being without prejudice, and being of a confidential and voluntary nature still apply.
